1. About This Program
The Shoulder Rebuild System ("the Program") is an online, structured exercise education program created and operated by The Shoulder Rebuild System ("we", "us", or "our"). The Program is designed to provide general exercise education, structured programming, and movement guidance for individuals experiencing non-traumatic, non-severe shoulder discomfort who wish to progressively rebuild shoulder capacity in a gym-based training environment.
The Program is offered as an educational and coaching resource only. It is not a clinical service, medical service, or allied health service, and does not constitute the provision of physiotherapy or any other regulated health profession under Australian law.
2. No Practitioner–Patient Relationship
Participation in the Program does not create, and is not intended to create, a physiotherapist–patient relationship, a therapeutic relationship, or any other practitioner–client relationship of a clinical or regulated nature between you and us or any individual associated with the Program.
The Program does not involve individual clinical assessment, diagnosis, or treatment. If you require individual clinical assessment or treatment for a health condition, you should consult a registered healthcare professional in person.
3. Educational Nature of Content
All content provided through the Program — including videos, written resources, programming guides, educational materials, and any check-in or review communications — is educational and informational in nature only. It is not intended to:
- Diagnose, treat, cure, or prevent any medical condition or injury
- Replace or substitute individual medical advice, physiotherapy assessment, or clinical treatment
- Constitute a recommendation to stop, alter, or commence any medical treatment
You are encouraged to seek appropriate professional medical advice before commencing the Program, particularly if you have any pre-existing health conditions, injuries, or concerns.
4. Voluntary Participation and Personal Responsibility
Participation in the Program is entirely voluntary. By participating, you acknowledge and accept that:
- You are responsible for making your own informed decisions regarding your participation in the Program and any exercise activity
- You have disclosed any relevant health conditions, recent injuries, or recent surgeries to a qualified healthcare professional and have received clearance to participate in structured exercise where appropriate
- Exercise carries inherent risk, and you accept that risk as a voluntary participant
- You will listen to your body and exercise within your own limits and capabilities
5. Medical Attention — When to Stop
You should stop exercise immediately and seek appropriate medical attention if you experience any of the following during or after participating in the Program:
- A significant worsening of pain or symptoms
- New or concerning symptoms such as chest pain, shortness of breath, dizziness, numbness, or tingling
- Any acute injury
- Any symptom that concerns you or feels unusual
Do not continue exercising through symptoms that concern you. When in doubt, seek qualified medical advice.
6. Program Eligibility
The Program is intended for adults who are experiencing non-traumatic, non-severe shoulder discomfort and who have access to standard gym or resistance training equipment. The Program is not appropriate for individuals who:
- Have recently undergone shoulder surgery or are in post-operative rehabilitation
- Have experienced a traumatic shoulder injury such as a fracture or dislocation
- Have been advised by a healthcare professional not to participate in structured exercise
- Are experiencing severe or rapidly worsening symptoms
If you are unsure whether the Program is appropriate for your situation, please consult a registered healthcare professional before purchasing.
7. No Guarantee of Results
Individual results from participating in the Program will vary. We make no representation, warranty, or guarantee that participation in the Program will result in any specific outcome, including but not limited to reduction in pain, improved shoulder function, or return to specific physical activities. Outcomes depend on individual factors including, but not limited to, the nature and duration of your condition, your baseline fitness, your consistency of participation, and your adherence to the program.
8. Intellectual Property
All content made available through the Program — including but not limited to videos, exercise programs, written guides, educational modules, graphics, and any other resources — is the intellectual property of The Shoulder Rebuild System and is protected by applicable Australian copyright law.
By purchasing the Program, you are granted a personal, non-transferable licence to access and use the Program content for your own individual use only. You must not:
- Share, copy, reproduce, distribute, or redistribute any Program content to any third party
- Screen-record, download (where not expressly permitted), or store content for the purpose of sharing
- Use any Program content for commercial purposes
- Allow any other person to access your account or use your login credentials
Unauthorised use or distribution of Program content may result in immediate termination of your access without refund, and may give rise to legal action.
9. Limitation of Liability
To the maximum extent permitted by Australian consumer law, The Shoulder Rebuild System and its associated individuals will not be liable for:
- Any injury, harm, loss, or damage arising from participation in the Program or the application of any exercise or information provided
- Any indirect, incidental, consequential, or special loss or damage of any kind
- Any loss resulting from your failure to seek appropriate medical advice prior to or during participation in the Program
Nothing in these Terms limits any rights you may have under the Australian Consumer Law, including any guarantees that cannot be excluded.
10. Modifications to the Program
We reserve the right to update, modify, or discontinue any aspect of the Program at any time. Where material changes are made, we will take reasonable steps to notify existing participants.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Queensland.
